Did you know that nobody really knows exactly how many federal criminal laws/regulations there are on the books? And that each day the average person is breaking at least 3 of them without even knowing it? And that every year Congress continues to criminalize a new crime each week?
This surely was not the case when Founding Father James Madison was alive, but he certainly could have predicted it. Madison helped write the U.S. Constitution and Federalist Papers and eventually became president himself in 1808. He was very keen to this type of danger saying:
“It will be of little avail to the people that the laws are made by men of their own choice, if the laws be so voluminous that they cannot be read, or so incoherent that they cannot be understood; if they be repealed or revised before they are promulgated, or undergo such incessant changes that no man who knows what the law is today can guess what it will be tomorrow.”
Well today there are over 5,000 federal criminal laws and somewhere between 300,000-500,000 regulations that can be enforced criminally. Even if just a misdemeanor or an arrest that doesn’t result in a conviction, the end result can still be disastrous in terms of lost money, time and reputation.
A large and powerful government enforcing Increasingly complex and incoherent laws that its citizens may or may not know they are breaking, takes us far, far away from the concept of individual liberty so cherished by our Founders. In fact it is a form of tyranny that’s leading us down a bad path that someday will be impossible to get off of.
Will we wise up before it’s too late?
This is part of a multi day series of quotes from our Founding Fathers. Here are links to days 1, and 2 respectively.
Your series prompted me to open my copy of America’s God and Country. The very first quote is a good one: “That great political idea, sanctifying freedom and consecrating it to God, teaching men to treasure the liberties of others as their own, and to defend them for the love of justice and charity more than as a claim of right, has been the soul of what is great and good in the progress of the last two hundred years.” – Lord Acton 1877
P.S. In 1881 he wrote, “All power tends to corrupt and absolute power corrupts absolutely.” (Which is why communism will never work this side of heaven.)

Oh that is a great quote Julie, thank you for sharing it! I didn’t know L acton also wrote that quote about power corruption. It’s a quote everyone seems to know but that no one takes seriously any more. Sigh.

Very well said Tricia. This sad, sad, sad. On so many levels.
But, I am always hopeful this time of year. My father was born on July 4, 1919. A part of the greatest generation crew. I so, I celebrate our men and women who fight for our liberty.
Be blessed.

Sad indeed Michael but like you said, there is always hope. And a special remembrance to your dad on his birthday tomorrow. God bless him for his service to our country and in keeping us free.

There’s a “parable” of sorts that was written by Harvard law professor Lon L. Fuller (1902 – 1978) in the first chapter of his excellent 1964 book The Morality of Law. The story is called “Eight Ways to Fail to Make Law”, but it’s also known as “The Story of King Rex”. It brings to life the Madison quote in your post. Here’s a link to a pdf containing that passage of Fuller’s book. Hope you enjoy it:

Even with all these over abundance of laws, the USA is still by far, the greatest country on earth. Israel may have the drop as to God’s promises, but pound for pound, from sea to shining sea, there is no other nation on earth………….. Happy 4th T.
